License Agreement
Please read this agreement carefully. By accessing and using the FieldSoft+ app, you agree to be bound by these terms.
Licensor grants Licensee a non-exclusive, non-transferable license to use the FieldSoft+ app on a monthly basis, commencing on the date of first use of the App by any user associated with Licensee. The license includes access to the mobile application ("Field App") and/or the office application ("Office App"), each requiring a separate license.
The current monthly per user fee covers a single license for either the Field App or the Office App. The license grants access to the respective application and its standard services. Any additional "Plus" features are not covered under the primary license fee and are subject to additional charges prior to the end of the billing period.
Licensor reserves the right to change the monthly license fee at any time. Licensee will be provided with a 30-day notice prior to any fee changes.
The monthly fee per user includes technical support and training exclusively for the use of FieldSoft+. Any additional support or training services beyond the scope of FieldSoft+ are not covered by this Agreement and may be obtained as separate services, subject to additional charges.
Licensee acknowledges acceptance of this Agreement upon the first use of the FieldSoft+ app by any user associated with Licensee.
Sharing of licenses is prohibited. Each license is designated for use by a single user. Any attempt to share, resell, sublicense, or transfer access to the App without prior written consent from Licensor is a violation of this Agreement.
Either party may terminate this Agreement by providing the other party with a 30-day notice in writing. Termination will be effective on the last day of the notice period.
The App is provided "as is" without warranty of any kind, expressed or implied. Licensor is not liable for any damages, whether direct or indirect, arising from the use of FieldSoft+.
Both parties agree to keep confidential any proprietary or confidential information obtained during the term of this Agreement. This obligation survives the termination of this Agreement.
In no event shall Licensor be liable for any consequential, incidental, indirect, special, or punitive damages arising out of or related to Licensee's use of or inability to use the App, even if Licensor has been advised of the possibility of such damages.
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
By accessing and using the FieldSoft+ app, Licensee agrees to be bound by the terms and conditions of this License Agreement. If you do not agree to these terms, do not access or use the application. Questions about this Agreement may be directed to info@fieldsoftplus.com.
